Viewing cable 08STATE75751, BLUE LANTERN LEVEL 3: PRE-LICENSE END-USE CHECK

If you are new to these pages, please read an introduction on the structure of a cable as well as how to discuss them with others. See also the FAQs

Understanding cables
Every cable message consists of three parts:
  • The top box shows each cables unique reference number, when and by whom it originally was sent, and what its initial classification was.
  • The middle box contains the header information that is associated with the cable. It includes information about the receiver(s) as well as a general subject.
  • The bottom box presents the body of the cable. The opening can contain a more specific subject, references to other cables (browse by origin to find them) or additional comment. This is followed by the main contents of the cable: a summary, a collection of specific topics and a comment section.
To understand the justification used for the classification of each cable, please use this WikiSource article as reference.

Discussing cables
If you find meaningful or important information in a cable, please link directly to its unique reference number. Linking to a specific paragraph in the body of a cable is also possible by copying the appropriate link (to be found at theparagraph symbol). Please mark messages for social networking services like Twitter with the hash tags #cablegate and a hash containing the reference ID e.g. #08STATE75751.

SUBJECT: BLUE LANTERN LEVEL 3: PRE-LICENSE END-USE CHECK
ON APPLICATION 050111895

REF: 2006 BLUE LANTERN GUIDEBOOK

 1. This is an Action Request. See paragraphs 2-4.

2. The Department's Office of Defense Trade Controls
Compliance (PM/DTCC) requests AIT-Taipei's assistance in
conducting a pre-license check on application 050111895 for
the export of defense hardware to Taiwan. AIT-Taipei is
requested to complete this Blue Lantern inquiry within 30
days. Lack of response to a Blue Lantern inquiry will affect
pending and future licenses involving parties to this license.

3. Reason for request: Unfamiliar end user, National Tsing
Hua University, and need to determine final end use of items.

4. Action: Department requests that AIT-Taipei conduct a
site visit to National Tsing Hua University (NTHU) in Taiwan
to confirm that it ordered the exact type and quantity of
items listed on the application. Also, AIT is urged to
assess NTHU's business operations, on-site security, and
general reliability as a recipient of USML items. Emphasize
that the unauthorized re-export or retransfer of USML items
is strictly prohibited.

If a site visit is not possible, please inform PM/DTCC case
officer. Rachael-Therese S. Joubert-Lin, Phone: 202-663-2950;
Email: JoubertLinRS@state.gov; SIPRNET:
JoubertLinRS@state.sgov.gov.

The following questions are provided as suggested guidance
with NTHU:

--Are you familiar with Attop International LLC?

--Did you order from Attop International LLC the exact type
and quantity of items listed
on this application?

--Is the NTHU the final end user of the items? Will the
items be integrated into a larger system? If so,
which system, and who will perform the integration?

-- Does the university understand the restrictions on United
States Munitions List (USML) items, especially the prohibition
against unauthorized re-transfers, re-exports, or changes in
end use?

--Is Attop International LLC an official supplier/contractor
for the National Tsing Hua University in Taiwan?
Does the National Tsing Hua University in Taiwan have any
other contracts with the company?

-- Are there any additional foreign parties (consignees,
freight forwarders, etc.) involved in this transaction?

End Action Request.
